Environmental Impairment Liability
All owners of property, whether residential or commercial can be liable for historical contamination on their land even when they are innocent and unaware of its presence. This liability can also attach to Directors and Officers of an organisation.
Background
The Environment Act (1995) presents a number of problems to Housing Associations as landowners.
The provisions of the legislation mean that any individual or organisation that owns land may be held liable for any harm caused by any contamination there in.
It is important to note that this risk relates to the ownership of land and is not restricted to the development risks only.
Liability
Local Authorities will have a contaminated land strategy and it is their duty to manage risks and ensure land is remediated as necessary.
Industrial or landfill contamination may have been present in the soil for many years and it is unlikely in these circumstances, that the polluter will be traceable. If the polluter cannot be identified, then liability will fall to the current owner or occupier even where they are innocent and completely unaware of the contamination.
Existing Landbank
Historical contamination causes perhaps the greatest risk as it is extremely difficult to quantify.
Rather than carry out a costly survey of all sites, FARR offers protection to cover your entire stock without the need for additional environmental inspections.
Our policy covers compulsory and voluntary clean up costs, third party liability and legal expenses.

The Government is increasingly encouraging developers to use ‘brownfield’ sites for housing. As good quality land becomes more difficult to find, it is likely that sites will need cleaning up before they are suitable to build on.

All of the above issues can be addressed by the purchase of an Environmental Impairment Liability policy. In addition to the cleanup costs, the policy can also indemnify you for business interruption (Loss of Profit or loss of Rental Value).
